Introduction

These Terms of Service ("Terms") govern your use of the GPX2Maps website and service operated by Lince Media LLC ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding your account, and for any activities or actions under your account. You agree not to disclose your login credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Service Description

GPX2Maps allows users to convert GPX files to Google Maps-compatible formats. The service is offered in two tiers:

  • Free Tier: Limited to 1 GPX file conversion per month.
  • Pro Tier: Unlimited GPX file conversions with additional features for a one-time payment that provides lifetime access.

Conversion Accuracy and Limitations

GPX file conversions to Google Maps navigation routes are not 100{}ccurate. This is due to technical limitations imposed by the Google Maps API, which restricts the number of waypoints that can be included in a single route.

GPX files often contain hundreds or even thousands of waypoints to accurately represent a route. However, Google Maps only allows a limited number of waypoints per route. Because we cannot include all original waypoints, our proprietary algorithm selects the most representative points to generate the best possible approximation of your original route.

By using our Service, you acknowledge and accept that:

  • Converted routes are approximations and may not exactly match the original GPX file path.
  • The accuracy of the conversion depends on the complexity of the original route and the number of waypoints in the source file.
  • You are responsible for verifying the converted route before using it for navigation, especially in unfamiliar or potentially hazardous areas.
  • We are not liable for any damages, losses, or inconveniences resulting from differences between the original GPX route and the converted Google Maps route.

Usage Limits and IP Collection

To enforce the usage limits of the Free Tier and prevent abuse of our Service, we collect and process IP addresses of users accessing the Service. By using GPX2Maps, you acknowledge and agree that:

  • We collect your IP address to enforce the 1 conversion per month limit for Free Tier users.
  • Your IP address is stored securely in our database along with conversion timestamps and usage metadata.
  • We may block access from VPN, proxy, datacenter, and other non-residential IP addresses to prevent fraudulent use and abuse of the Free Tier.
  • IP addresses are used solely for fraud prevention, usage limit enforcement, and service security purposes.
  • Pro Tier users are not subject to these IP-based usage limits.

This IP collection is necessary for the legitimate interests of maintaining fair usage of our Service and preventing abuse. The data is retained for as long as necessary to enforce usage limits (monthly reset) and prevent circumvention attempts. Payment Terms

The Pro tier of GPX2Maps is offered as a one-time payment for lifetime access. Your payment information is processed securely by our payment processor, Stripe.

By purchasing the Pro tier, you agree that:

  • You are authorizing us to charge the one-time fee for the Pro tier.
  • In case of failed payments, we reserve the right to deny access to Pro features until payment is successfully processed.

Refund Policy

All payments are final and non-refundable.

GPX2Maps offers a free tier that allows you to test the service with 1 conversion per month before purchasing. This free trial is designed to let you evaluate the service and ensure it meets your needs before making a purchase. By purchasing the Pro tier, you acknowledge that you have had the opportunity to test the service and are satisfied with its functionality.

Fair Use Policy

The Pro tier provides unlimited conversions for personal and reasonable commercial use. However, to ensure fair access for all users and prevent abuse, the following restrictions apply:

  • You may not resell, redistribute, or offer GPX2Maps conversions as a service to third parties.
  • Automated bulk conversions using scripts, bots, or similar tools are prohibited.
  • Each Pro account is for individual use only and may not be shared with multiple users or organizations.
  • We reserve the right to monitor usage patterns and suspend or terminate accounts that exhibit abusive behavior.

Violation of this Fair Use Policy may result in immediate termination of your account without refund.

Intellectual Property

The Service and its original content, features, and functionality are and will remain our exclusive property and that of our licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

Our Service allows you to upload, store, and share content, particularly GPX files. You maintain ownership of any intellectual property rights that you hold in that content.

When you upload content to our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing our Service to you.

You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your content in the manner contemplated by the Service and these Terms.
  • Your content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

Disclaimer Regarding Google Maps

GPX2Maps is not affiliated with, endorsed by, or in any way officially connected with Google LLC or Google Maps. Google Maps is a trademark of Google LLC.

Our Service helps users convert GPX files to view them on Google Maps, but we do not claim any ownership over Google Maps or its related services. All rights, title, and interest in and to Google Maps remain exclusively with Google LLC.

Users are responsible for complying with Google's Terms of Service when using Google Maps with content converted through our Service.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Limitation of Liability

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content

Warranty Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Florida, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
